Terms & Conditions

This document contains additional contractual terms, conditions, and limitations between you and Premier
Vacations and Events, Inc. (PREMIER) with respect to the 2025 K-Love Cruise (“CRUISE”) scheduled onboard
the Carnival Magic, a cruise ship operated by Carnival Cruises (“CRUISE LINE”).
These Terms and Conditions,
and the CRUISE LINE’s Passage Contract define and limit the rights, responsibilities and limits to liability
applicable to PREMIER, the CRUISE LINE and you. These documents contain important limitations on your
rights, limit PREMIER and the CRUISE LINE’s liability, and constitute legally binding agreements. By making a
reservation for the Cruise, or by acceptance and/or use of the CRUISE LINE’s Passage Contract, you and all
person(s) named thereon as passengers or guests confirm that you and they have read and understand each
and every term, condition, and provision of these Terms and Conditions for 2025 K-Love Cruise and the
CRUISE LINE’s Passage Contract and agree to be bound thereby.


Limited Role of PREMIER and Other Parties
Educational Media Foundation (EMF) dba K-LOVE serves solely as the marketing sponsor for the CRUISE.
PREMIER (and its affiliates including but not limited to Premier Christian Cruises) is the marketer of the
CRUISE and producer of the added entertainment offerings unique to the CRUISE. PREMIER acts solely in its
capacity as tour operator, sales agent and independent contractor in arranging the CRUISE. Neither PREMIER
nor EMF control or direct the operational or navigational activities of the vessel or its crew in any manner
whatsoever nor for shore excursions and other services provided aboard the ship or ashore by independent
third parties. Neither PREMIER nor EMF have control over or responsibility for inspecting or maintaining the
vessel and its equipment, warning of potential hazards on or off the ship, or supervising CRUISE LINE’s
activities or the vessel’s crew. Passenger(s) hereby waive and release PREMIER and EMF from any and all
liability and claims arising from any injury, death or loss to passenger related to the CRUISE, and Passenger(s)
agree to indemnify PREMIER and EMF from any and all such claims that Passenger or anyone acting on their
behalf may bring against any person or entity whatsoever.


Cruise Line Passage Contract
The Cruise Line Passage Contract (sometimes referred to as Conditions of Carriage or Ticket Contract) defines
the rights and responsibilities as between Passenger and CRUISE LINE and contains important limitations of
liability and other terms which limit your legal rights. A copy of the cruise line’s Passage Contact applicable to
the CRUISE can be viewed at https://www.carnival.com/popups/bookingengine/reservation-terms-and-conditions.aspx . Passenger agrees that PREMIER and EMF shall be entitled to all rights, defenses and immunities available to the cruise line under the Passage Contract.


Cancellation by Speakers or Artists
PREMIER shall not be liable for failure of any speaker or artist or musician (TALENT) to attend on board or to
perform during the CRUISE. Passenger acknowledges and understands that advertised Speakers and Artists,
and the onboard entertainment program, are subject to change or cancellation and that PREMIER shall not
be liable to passenger(s) if performance(s) or events by TALENT are prevented, rescheduled or cancelled for
any reason whatsoever. PREMIER shall have the right, but not the obligation, to substitute alternative
TALENT in the event any advertised TALENT do not perform during the CRUISE. PREMIER shall also have the
right to change, postpone, or terminate any portion of the entertainment program at any time before or
during the CRUISE. In all such cases, PREMIER shall have no liability to any passenger for any loss, damage or
expense whatsoever by reason of such changes or cancellations.


Changes in Itinerary, Substitution of Vessel
The CRUISE LINE’s Passage Contract defines passengers’ rights and CRUISE LINE’s and liability in the event of
change in itinerary or schedule, or substitution of vessel. PREMIER shall have no liability whatsoever to
passenger for such occurrences.


Deposit and Payments
A non-refundable $150 deposit per person is charged at the time of booking. Passengers may choose to pay
in full at the time of booking or to use a payment plan. If using a payment plan (1) the remaining balance will
be paid in equal monthly payments and must be made by automatic credit card draft and (2) the first
payment starts one month after booking and continues on approximately the same day of the month until
the account is paid in full. If any automatic payment is unsuccessful after five attempts, the payment plan
will have failed and the reservation will be subject to cancellation unless reinstated with payment. It is the
sole responsibility of the cardholder to contact PREMIER and restart the agreed upon payment plan. All
delinquent payments are due at that point in time. An administrative fee of $35 will be assessed for any
declined charge and for any changes to requested by passenger relating to a payment plan (including
substitution of credit cards). In addition to the fare and fees outlined above, a $40 booking fee is applied as
to each booked passenger.


Changes in Bookings
Any changes in bookings may be made only by the person making the reservation. The following fees will
apply in the case of each change in booking:
•Change of primary booking passenger or assignment of reservation to another individual: $100
•Change of accompanying passenger: $50
•Addition of new passenger to an existing reservation: $100 plus applicable cruise fare, port charges,
fees and gratuities
•Correction to name spellings made within 60 days of sailing: $50
•Change of cabin selection: $100 plus any difference in cabin fare
•Change of names due to marriage: $50


Cancellation Charges

This PREMIER Cancellation Policy supersedes the policies of the CRUISE LINE including its terms and conditions and Passage Contract. ALL DEPOSITS AND PAYMENTS FOR THE K-LOVE CRUISE ARE NON-- REFUNDABLE. Travel Insurance can provide financial reimbursement in the event of certain contingencies and is strongly recommended. Passengers can purchase travel insurance from Travel Guard https://www.travelguard.com/ . It is the sole responsibility of each passenger to purchase travel/cancellation insurance. In the event the CRUISE is cancelled for any reason, passengers’ reservation will be automatically transferred to the next K-Love Cruise where passenger will be booked into accommodations of similar or higher category. If passenger prefers to receive a refund, passenger must write or email PREMIER within 15 days after receipt of the cruise cancellation notice from PREMIER or the date of departure, whichever is earlier, requesting a refund to: PREMIER, Attn: Cancellations, 707 Westchester Drive, Suite 201, High Point, NC 27262 / info@premiercruises.com. Please allow up to 90 days for refund processing.

 

Who May Sail

Passenger is responsible to ensure everyone in their booked reservation is eligible to sail. In order to sail on the CRUISE, all passengers must meet the following criteria:
•Infants must be at least six (6) months or older on the date of departure
•Due to limited neo-natal medical capabilities onboard, women who are pregnant must have a letter
from their doctor verifying that they will be less than 24 weeks pregnant on the date of departure,
that mother and baby are in good health and fit to travel, and that the pregnancy is not deemed high
risk.
•Individuals under the age of twenty-one (21) may sail provided they either (a) travel in the same
stateroom with an individual twenty-five (25) years or older at the time of departure, (b) travel in the
same stateroom with their lawful spouse (proof of age and marriage required), or (c) travel in the
same or an accompanying stateroom as their parent or guardian who are also sailing on the CRUISE.
•Individuals who meet the CRUISE LINE’s vaccination and testing requirements in effect at
the time of departure.


Passengers not conforming to these policies will be denied boarding and no refund of the cruise fare will be
issued. There are NO EXCEPTIONS to these policies.


Documentation
Proper travel documentation is required at embarkation and throughout the CRUISE and is the sole
responsibility of the passenger. The Passenger is responsible for and shall comply with any governmental
travel requirements, laws or regulations for all ports of call on the Cruise Ship's itinerary. At embarkation all
Passengers must present for inspection their Ticket and Passage Contract, a valid Passport (valid for six
months after the scheduled date of disembarkation) and any visa, entry or exit permit, required by any port
on the Cruise Ship's itinerary. Passengers are strongly advised to check for all legal requirements for
travelling abroad and at the various ports to include the requirement of visas, immigration, customs and
health. Any passenger traveling without proper documentation will not be allowed to board the vessel and
no refund of the cruise fare will be issued. Depending on passengers’ nationality, required travel
documentation may include such items as a valid passport (valid for at least six months after the scheduled
end date of the CRUISE), visas, health certificates, and COVID-19 vaccination certificates. Additional
information on travel documentation requirements for U.S. citizens and residents can be found on the U.S.
State Department, U.S. Customs and Border Protection and Centers for Disease Control and Prevention
websites.


Passenger agrees to abide by cruise line’s policies and protocols regarding COVID-19 and other infectious
diseases as may be in place at the time of the CRUISE. A summary of CRUISE LINE’s current health protocols
and COVID-19 policies, which are subject to change without notice, can be found at

Cruise Fare and Other Charges
Cruise Fare Rates are per person based on double occupancy and include the cruise fare, meals on board
ship, entertainment, and all concert activities. The cost for third, fourth, and fifth passengers sharing a
stateroom with two full fare passengers will be $499 per person. In addition to Cruise Fare, all passengers
shall pay Fees (including Port Charges, Documentation Fees and Gratuities) of $259 per person. Included in
this total amount are Port Charges which are comprised of U.S. Customs Fees, International Departure Taxes
and Non--Commissionable cruise line charges (government fees are subject to change), Processing Fees
which are comprised of postage, materials, and fees related to processing the reservation, and pre-paid
Gratuities (current rate) which are prepaid to your cabin steward, waiter, and busboy. These charges will be
included on your statement from PREMIER. CRUISE LINE and PREMIER reserve the right to assess each
passenger for any fee or tax Increases and any applicable fuel surcharge as a fee added to Passenger’s
shipboard account.


Costs Not Included in Cruise Fare
Shore and air transportation, transfers, optional cancellation and travel insurance, shore excursions, onboard
medical expenses, onboard internet and ship to shore telephone charges, items of a personal nature (such as
laundry, gift shop purchases, spa services, onboard photo gallery, art auctions, casino expenses), certain
beverages (sodas, bottled water, alcoholic beverages and beverage packages), and optional premium
restaurant and food venues are not included in Cruise Fare.


Advanced or Delayed Sailings
In the event of strike, lockouts, riots or stoppage of labor from whatever causes, or for any other reason
whatsoever beyond the control of PREMIER or CRUISE LINE, CRUISE LINE in its sole discretion may cancel,
advance, or postpone any scheduled sailing or call at any port and may (but is not obligated to) substitute
another vessel, and neither the CRUISE LINE nor PREMIER shall be liable for any loss whatsoever to
passengers by reason of such cancellation, advancement, postponement, or substitution.


Photography
PREMIER and/or its promotional partners have the exclusive right to include photographic, video and other
visual portrayals of passengers in any medium of any nature whatsoever for the purpose of trade,
advertising, sales, publicity or otherwise, without compensation to passengers, and all rights, title and
interest therein (including all worldwide copyrights therein) shall be PREMIER’s sole property, free from any
claims by passengers or any person deriving any rights or interest from passenger.


Forum Selection
It is agreed by and between the passenger and PREMIER that all disputes and matters whatsoever and of any
kind or nature, arising between Passenger and PREMIER, including but not limited matters connected to or
arising from the CRUISE and/or these Terms and Conditions, shall be litigated, if at all, before the United
States District Court for the Southern District of Florida in Miami, or as to those lawsuits to which the Federal
Courts of the United States lack subject matter jurisdiction, before a court located in Miami--Dade County,
Florida, U.S.A. to the exclusion of the Courts of any other county, state or country. All time requirements for
providing notice of claims, for commencement of actions, and for service of process applicable to CRUISE
LINE under the Passage Contract shall also apply as to any claim or action by Passenger against PREMIER or
any of its affiliates, parents or subsidiaries.
